1. Introduction
These Terms and Conditions govern the booking and use of safari holidays, tours, accommodation, and related travel services offered by Holiday Kenya Safaris Ltd. (“Holiday Kenya Safaris”, “we”, “us”, or “our”), a tour operator registered and operating in Kenya with its registered office at KTDA Plaza, Nairobi, Kenya.
By making a booking with us, whether through our website, by email, by phone, or in person, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions on behalf of yourself and all persons named on the booking. If you are booking on behalf of another person, you confirm that you have the authority to accept these terms on their behalf.
Holiday Kenya Safaris is an accredited tour operator under the Kenya Tourism Regulatory Authority (TRA) and a member of the Kenya Association of Tour Operators (KATO). Our services are covered under the KATO bonding scheme, which provides an additional layer of financial protection for our clients.
2. Bookings and Payments
2.1 Making a Booking
A booking is confirmed once we have received your signed booking form or written confirmation, together with the required deposit. Until both have been received, a quoted itinerary or price does not constitute a confirmed booking and remains subject to availability.
2.2 Deposits and Balance Payments
- A non-refundable deposit of [confirm: typically 20-30%] of the total package cost is required to confirm a booking.
- The remaining balance is due no later than [confirm: typically 60 days] before the departure date.
- Bookings made within [confirm: typically 60 days] of departure must be paid in full at the time of booking.
- Certain premium camps, fly-in safaris, and gorilla trekking permits (Rwanda and Uganda) may require full payment at the time of booking due to supplier policies outside our control. We will notify you clearly if this applies to your itinerary.
2.3 Accepted Payment Methods
Payments can be made by bank transfer, major credit or debit card, or other methods we may specify at the time of booking. Card payments may incur a processing fee, which will be disclosed before payment. All prices are quoted in US Dollars (USD) unless otherwise stated, with Kenya Shilling (KES) equivalents available on request.
2.4 Price Changes
Prices are based on costs, exchange rates, park fees, and supplier rates at the time of quotation. We reserve the right to adjust the price of an unconfirmed quotation at any time. Once a booking is confirmed and the deposit paid, we will only pass on price increases arising from government-imposed changes such as park fee increases, new taxes, or fuel surcharges, and will notify you of any such change as soon as reasonably possible.
3. Cancellations and Refunds
All cancellations must be submitted in writing to info@holidaykenyasafaris.com. The effective cancellation date is the date we receive your written notice, not the date it was sent.
Because Holiday Kenya Safaris pays camps, conservancies, park authorities, and other suppliers in advance to secure your booking, cancellation charges apply on the following scale, calculated as a percentage of the total package cost:
- More than [confirm: 60] days before departure: loss of deposit only
- [confirm: 45-59] days before departure: 50% of total package cost
- [confirm: 30-44] days before departure: 75% of total package cost
- Less than [confirm: 30] days before departure, or no-show: 100% of total package cost, no refund
Some accommodation providers, particularly small luxury camps and fly-in safaris, apply stricter cancellation terms than the scale above. Where this applies to your booking, we will disclose the specific supplier policy before you confirm.
Any refund due will be processed within [confirm: 14-30] days of the cancellation date, less any non-recoverable costs already paid to third parties (park fees, permits, flight tickets) and any bank or payment processing charges.
If we are forced to cancel your trip due to circumstances within our control, you will receive a full refund or the option to rebook for an alternative date. Section 7 (Force Majeure) governs cancellations arising from circumstances outside our control.
4. Amendments to Your Booking
If you wish to change your travel dates, itinerary, or the number of travellers after a booking is confirmed, we will do our best to accommodate the change, subject to availability and any amendment fees charged by our suppliers. An administration fee of [confirm amount] may apply per amendment. Amendments requested within [confirm: 30] days of departure may be treated as a cancellation and rebooking, subject to the cancellation terms in Section 3.
5. Travel Documents, Visas, and Entry Requirements
Clients are responsible for ensuring they hold a passport valid for at least six months beyond the intended return date, and for obtaining any visas, Electronic Travel Authorisations (eTAs), or other entry documents required for Kenya and any other countries included in the itinerary, including Tanzania, Uganda, Rwanda, or Zanzibar where applicable.
We are happy to advise on current entry requirements as a courtesy, but the final responsibility for holding valid, correct documentation rests with the client. Holiday Kenya Safaris is not liable for any cost, loss, or missed travel arising from a client’s failure to hold the required travel documents.
Where an itinerary includes gorilla or chimpanzee trekking permits in Rwanda or Uganda, these are issued by the relevant national wildlife authority, are non-transferable, and are subject to that authority’s own cancellation and refund rules, which are separate from and in addition to our own cancellation terms in Section 3.
6. Health, Vaccinations, and Travel Insurance
Clients are responsible for consulting a doctor or travel health clinic, ideally 6 to 8 weeks before departure, regarding recommended and required vaccinations, malaria prophylaxis, and any other health precautions for travel to East Africa. Proof of yellow fever vaccination may be required on arrival if travelling from a yellow fever endemic country.
Comprehensive travel insurance, covering medical treatment, emergency evacuation, trip cancellation, and loss of personal belongings, is strongly recommended for all clients and is a condition of travel with us for any itinerary involving remote areas, gorilla trekking, or hot-air balloon safaris. We can recommend suitable providers on request but do not sell travel insurance directly.
7. Force Majeure and Changes to Itineraries
We reserve the right to alter, postpone, or cancel any itinerary, activity, or accommodation booking due to circumstances beyond our reasonable control, including but not limited to adverse weather, flooding, wildlife or park closures, political instability, civil unrest, epidemic or pandemic restrictions, strikes, or changes imposed by government or park authorities.
Where such changes are necessary, we will substitute comparable arrangements wherever possible and will keep you informed as early as we reasonably can. Holiday Kenya Safaris will not be liable for any additional costs, losses, or inconvenience arising from circumstances of this nature, though we will always work to minimise the impact on your trip.
8. Liability
Holiday Kenya Safaris acts as an agent and organiser in arranging accommodation, transport, guiding, and activities provided by third-party suppliers, including lodges, camps, airlines, and ground transport operators. While we select our partners carefully and only work with reputable, licensed operators, we are not liable for the acts, omissions, negligence, or default of these third-party suppliers, except where required by Kenyan law.
Safari and outdoor activities, including game drives, walking safaris, gorilla trekking, and hot-air balloon safaris, carry inherent risk due to the presence of wild animals and remote terrain. Clients participate in all activities at their own risk and are expected to follow the safety instructions of their guides at all times.
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our own negligence, or for any other liability that cannot be excluded or limited under Kenyan law.
9. Conduct and Guide Authority
Guests are expected to follow the reasonable instructions of their guide or camp staff at all times, particularly regarding safety around wildlife and conduct during game drives, walking safaris, and cultural visits. Holiday Kenya Safaris and its guides reserve the right to refuse or remove a client from an activity where their conduct poses a safety risk to themselves, other guests, staff, or wildlife, without refund for the affected portion of the trip.
10. Complaints and Disputes
If you experience a problem during your trip, please raise it with your guide or the relevant camp or lodge management immediately, so that we have the opportunity to resolve it while you are still travelling. Most issues can be addressed quickly on the ground.
If the matter remains unresolved, please submit a written complaint to info@holidaykenyasafaris.com within [confirm: 30] days of the end of your trip, including as much detail as possible. We aim to acknowledge complaints within [confirm: 7] working days.
These Terms and Conditions, and any dispute arising from your booking with Holiday Kenya Safaris, are governed by the laws of Kenya, and the courts of Kenya shall have exclusive jurisdiction, without prejudice to any right you may have to bring a claim in your country of residence where applicable consumer protection law requires it.
11. Website Use and Intellectual Property
All content on holidaykenyasafaris.com, including text, photographs, itineraries, and logos, is owned by or licensed to Holiday Kenya Safaris and may not be copied, reproduced, or used for commercial purposes without our prior written consent.
12. Privacy
Information you provide when making a booking or enquiry is handled in accordance with our Privacy Policy, available at holidaykenyasafaris.com/privacy-policy.
13. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our services or legal requirements. The version in effect at the time you make a booking will apply to that booking. We recommend reviewing this page periodically.
